Effective July 2, 2026. By using Opivex you agree to these terms.
Opivex ("Opivex", "we", "us") operates an online marketplace that connects content creators ("Creators") with independent short-form video editors and production teams ("Editors"). Opivex itself is not the editor, does not perform the editing work, and is not a party to any agreement between a Creator and an Editor.
You must be at least 18 years old and legally able to enter contracts. You are responsible for the security of your login credentials and for all activity that happens under your account. If you sign up on behalf of a company, you represent that you have authority to bind that company.
We may suspend, restrict, or terminate any account that we believe violates these Terms, our Acceptable Use policy, applicable law, or the safety of other users, with or without notice.
Editors set their own prices, turnaround times, portfolio content, and availability. Creators choose which Editors to hire, brief them, and approve or reject their deliverables. Opivex provides the tools (profiles, messaging, briefs, delivery, payments, dispute support) but is not a party to the underlying service contract between Creator and Editor.
Any statements, claims, portfolios, ratings, or examples posted by Editors or Creators are the responsibility of the user who posted them. We do not endorse any user or guarantee any specific outcome, quality of work, timeline, or business result.
All payments run through our payment processor (Stripe). When a Creator posts a bounty, boost, subscription, or team project, funds are collected and held. Payouts to Editors are released when the Creator approves the delivery, or per the automatic release rules stated in the workspace.
Opivex charges a platform service fee on transactions to operate and maintain the marketplace. The fee is included in the total the Creator pays and is retained by Opivex from the gross transaction; the Editor receives the remainder. Prices displayed on Opivex are in U.S. Dollars unless stated otherwise.
Refunds: Once an Editor has begun work, refunds are not automatic and are decided at Opivex’s discretion based on the workspace record and the Acceptable Use policy. If an Editor declines a hire before starting work, funds are returned to the Creator.
Opivex Pro is billed monthly and can be cancelled from your profile at any time. Cancellation takes effect at the end of the current paid period; we do not pro-rate partial months.
You retain all ownership of the content you upload (raw footage, briefs, delivered edits, messages, etc.). By uploading, you grant Opivex a worldwide, non-exclusive, royalty-free license to host, transmit, back up, display within the workspace, and process that content solely to operate the service.
When a Creator approves an Editor’s delivered work and pays in full, the Creator receives the rights to use the delivered edit in accordance with the brief and any specific terms agreed to in the workspace. Editors retain the right to display the final work in their public portfolio unless the Creator and Editor agree otherwise in writing inside the workspace.
You represent that you own or have the necessary rights to all footage, music, images, brand assets, and other material you upload, and that its use on Opivex does not infringe any third party’s rights.
You may not use Opivex to:
Violations may result in message filtering, hidden listings, refunds to affected users, permanent account termination, and where appropriate, referral to law enforcement.
Team Mode lets a Creator split one budget across multiple roles and optionally reserve a bonus pool tied to a public performance metric (e.g., views, watch time, engagement). The Creator is solely responsible for choosing the metric, evaluation window, and awarding the bonus in good faith based on the data available at evaluation time. Opivex facilitates the split and payout but does not verify third-party analytics.
Creators and Editors should first try to resolve any dispute in the workspace. If that fails, either party may open a dispute with Opivex within 14 days of delivery. We may review the workspace record, request additional information, and issue a resolution (which may include partial or full refunds, extensions, or replacement of the Editor). Our resolution is final for platform-held funds.
You may close your account at any time. We may suspend or terminate your account, remove content, cancel pending transactions, or refuse service if we reasonably believe you have breached these Terms, our Acceptable Use policy, or applicable law, or if required by our payment processor. Sections that by nature should survive termination (payments, IP, disclaimers, indemnity, dispute resolution) will survive.
The service is provided “as is” and “as available.” To the fullest extent permitted by law, Opivex disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the quality, timeliness, accuracy, or reliability of any user or their work. Opivex does not guarantee any specific business result, view count, engagement, or revenue.
To the fullest extent permitted by law, Opivex, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of the service.
Our total aggregate liability to you for any claim relating to the service is limited to the greater of (a) the total fees you paid to Opivex in the three (3) months immediately preceding the claim, or (b) one hundred U.S. dollars ($100).
You agree to defend, indemnify, and hold harmless Opivex from any claim, loss, damage, liability, or expense (including reasonable attorneys’ fees) arising out of your content, your use of the service, your violation of these Terms, or your violation of any third-party right.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be resolved by binding individual arbitration under the rules of the American Arbitration Association, in English, seated in Delaware. You and Opivex each waive the right to a jury trial and to participate in a class action. This clause does not prevent either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property.
We may update these Terms from time to time. If we make a material change, we’ll notify signed-in users by email or in-app notice. Continued use of the service after the change takes effect means you accept the updated Terms.
